Welcome to the IKO!
Thank you for using our services and the material on www.ikointl.com and the IKO mobile App (hereafter referred to as the "website"). The website is maintained by the International Kiteboarding Organization SRL (“IKO”), located at Plaza Novus Mare, Cabarete, Dominican Republic.
These Terms and Conditions of Use (the "Terms of Use") apply to the IKO website located at www.ikointl.com, and all associated sites linked to www.ikointl.com by the IKO, its subsidiaries and affiliates.
BY USING THE WEBSITE AND OUR SERVICES, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE.
Our services are diverse, and additional terms may apply. Those additional terms become part of your agreement with us if you use those services.
Your IKO Account
You may need an IKO Account in order to use some of our services. To protect your account, keep your password confidential. You are responsible for any activity on or through your IKO Account. Try not to reuse your IKO Account password on third-party sites/apps.
We may display your full name, profile photo, and courses you undertake in connection with our services in your IKO Account. We will respect the choices you make to limit sharing or visibility using settings in your IKO Account. For example, you can refuse to index your page so it does not appear in the community or on search engines.
We do not claim ownership of the content you add to your profile, but you give us permission to use the content you upload to your IKO Account when related to our services. You can end this use at any time by deleting your content or account. To learn more about how we use information, please review our privacy policy.
Submitting your material to us
All remarks, suggestions, ideas, graphics, comments, or other information that you send to the website (other than information we promise to protect under our privacy policy) becomes and remains our property, even if this agreement is later terminated. This information won’t be treated as confidential nor will it generate compensation.
You cannot sue us for using the ideas you submit. You acknowledge that you are responsible for any submission you make and that you have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright. You should not submit any content or information that infringes or violates other people‘s rights.
Restrictions on the use of our online material
All online material on the website, including and without limitation, text, software, names, logos, trademarks, service marks, trade names, images, photographs, illustrations and video clips are copyrighted intellectual property. All usage rights are owned and controlled by the IKO.
You may not copy, reproduce, republish, upload, post, transmit or distribute any part of this material in any way or for any other purpose without prior consent. Neither may you add, delete, distort or misrepresent any content on the website. Any attempts to modify any online material, or to defeat or circumvent our security features are prohibited.
Booking and cancellation policies for Pro courses
IKO ITC Candidate Requirements:

Be at least 18 years old.

Be a certified IKO Kiteboarder Level 4 or ride at an equivalent level*.

Have a valid IKO Assistant certification.

Have a valid first aid and CPR certificate. (Neither online certification nor certificate older than 2

years are accepted)

Be able to read, write and speak fluently the language in which the course is given.

Sign the ITC Candidate waiver and participation form.
Release of Liability and Indemnity Agreement
I hereby voluntarily request participation of an IKO Pro Training with full knowledge of the risks involved in the practice of kiteboarding. I declare being aware of the course requirements and that I fulfill them all without exception. I assume any and all risks of injury and I agree that IKO, related employees or the booking agent cannot be held responsible in any way for injuries or damages suffered by me as a result of my participation in this activity. Furthermore, I hereby release and discharge the released parties and agree not to file suit against them.
I understand that if I do not meet the prerequisites and level required by the end of the course, I will not be certified by the course Trainer and will have to complete post course requirements such as an Internship to complete under the direct supervision of an Instructor Level 2 for a minimum of 20 hours. The course Trainer can even refuse my participation to the course if some prerequisites are missing. I will not hold the course Organizer, the Trainer, or IKO responsible.
During the course, I must satisfy the final evaluation criteria referred on the evaluation chart of the course manual.
If I cancel my booking more than 1 month before the course, the Organizer will refund my deposit (minus the operational charges). If I cancel less than 1 month before the course, the Organizer will not refund my deposit. If the course is cancelled within any period of time, the Organizer will refund my deposit but will not refund my travelling expenses. However, the IKO fee paid on the website will never be refunded to you if you or the organizer cancel the course. The fee can be used for any similar course during a period of one year. The booking policy is defined by each school independently. A school cannot cancel an event less than a month before the start date of the course.
Once I become an IKO qualified pro member, I will be able to start working according to IKO standards. I will follow the quality Standards of the IKO. To remain an active member I need to ensure my yearly membership remains up to date.
I have read and understood this Deed of Release and freely accept and agree to be bound by its terms and conditions. I will give due respect to the safety of others and myself at all times whilst on the course.
How and when should I book my travel and accommodation?
A Pro course listed in the Training Calendar is not necessarily confirmed. The course will be confirmed at least one month before the start date, or as soon as four candidates have booked onto it. You will be notified by email and through your IKO Profile as soon as the course is confirmed. Travel arrangements made before a course is confirmed will not be refunded by the IKO or the Organizer if the course does not go ahead. The Organizer can help you organize your stay when a course is confirmed.
How and when can I cancel?
If you cancel your participation in an IKO Pro Course less than one month before the beginning of the course, the course is non-refundable unless the center agrees to a refund. The center has the right to keep 100% of the Pro Course fee if nothing different has been agreed on between the center and the candidate. Any other agreement on cancellation policy between the center and the candidate has to be written and agreed on by both parties to be valid.
How and when can the Organizer cancel?
The Organizer can cancel a Pro course up to one month before the start date if less than four candidates have booked the course. As soon as four candidates have booked the course, the course is confirmed and the Organizer cannot cancel it. In the case of cancelation by the Organizer, the Center Fee should be refunded (including any administrative costs) or, with your agreement, the Organizer should transfer you to another Organizer without any additional cost. Make sure you confirm the booking policy with the Organizer before booking a course.
Waiver
In consideration of the courses and/or activities, you understand and acknowledge that kiteboarding activities have inherent dangers that no amount of care, caution, instruction, or expertise can totally eliminate. You expressly and voluntarily assume all risks of personal injury or death sustained while participating in kiteboarding activities whether or not caused by the negligence of the released parties.
You agree that you will operate the said kiteboarding equipment in a reasonable and safe manner so as not to endanger the lives of third party persons or property of any individual.
You confirm that you are an open water swimmer, you are not under the influence of alcohol or drugs, you are in good health and have no medical condition that may interfere with the practice of kiteboarding activities. You are not pregnant or nursing. You have no mental impairment that may affect your judgment of danger and information given during the practice of kiteboarding activities. You further represent that you are at least 18 years of age or that, as the parent or legal guardian, you waive and release any and all legal rights that may accrue to you or to the minor you are responsible for as the result of any injury that your son or daughter (minor)[BZ15] may suffer while engaging in kiteboarding activities.

Jurisdiction
If you use our website, you are responsible for compliance with any applicable local laws. However, the laws of the Dominican Republic will govern these Terms and any claim, without regard to conflict of law provisions.
In the event of any violation or threat to violate the IKO and/or its affiliates' intellectual property rights, the IKO and/or its affiliates may seek injunctive or other appropriate relief by opening a dispute which can be resolved with the help of a mutually agreed-upon mediator in Santo Domingo/Dominican Republic. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.
If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at Santo Domingo/Dominican Republic under the rules of the Dominican administration.
Termination of this agreement
We are constantly changing and improving our services. We may add or remove functionalities or features, and we may suspend or stop a service altogether.
You can stop using our services at any time, although we’ll be sorry to see you go. You may terminate this agreement by destroying all materials obtained from the IKO. The IKO may also stop providing services to you, or add or create new limits to our services at any time. If, in its sole judgment, you breach any term or condition of this agreement, the IKO may terminate this agreement without notice to you.
Privacy Policy
The IKO takes your privacy seriously. Please read the following Privacy Policy carefully to learn more about the IKO and the IKO’s business partners' use of your personal identifying information that the IKO collects when you visit www.ikointl.com and the IKO mobile App (hereafter referred to as the "website"). The IKO reserves the right to change this Privacy Policy at any time without notice to you. You are therefore responsible for regularly reviewing this Privacy Policy.
Information we collect
- Personal data provided by you: We collect and store any personal identifiable information you provide to us when you create your profile and by using certain features on our website. You are under no obligation to provide us with personal information of any kind, however, your refusal to do so may prevent you from using certain features or accessing certain products provided on our website.
- Automatic data: We and our authorized third-party agents receive and store various types of information when you interact with our website that does not include any of your personal information such as your IP address, cookies, devices you are using, the language displayed, geographic location and other data in order to analyze statistics and trends, diagnose and administer our website and to improve the quality of our services.
Disclosure of your Information
The IKO will not sell or rent your personal identifying information without your consent.
The IKO may send personal identifying information about you to third parties as follows:
- Service providers: we may share the information we have collected to various third-party services that help us provide our services (“service providers”). All our service providers are required to protect your information and limit their usage to the completion of services for our website only.
- Our team members: our team or authorized consultants may have access to your personal information in order to be able to develop and conduct our business properly.
- Transfers: if our company is acquired, your personal information would be among the transferred assets.
- Required by law or to protect rights: if we believe the release of information about you is necessary to respond to a legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.

The IKO uses industry-standard SSL encryption to protect data transmissions. Despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other types of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.
Third-party websites
Our website contains referrals to and links to other websites. Such links should not be seen as an endorsement, approval or agreement with any information or resources offered through our website. If in doubt, always check the Uniform Resource Locator (URL) address provided in your browser to see if you are still on our website. Third-party websites are not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information on third-party websites. Updating your personal information and privacy preferences
You have the right to access and correct your personal information at any time and request to receive an exported file of the personal data from your IKO Account. You can request that we erase any personal data that we hold about you except the data we are obliged to keep for administrative, legal, or security purposes.
If you no longer wish to receive emails or other communications from us, you may edit the subscription tab in your account. Keep in mind that you will still receive emails regarding the services you have subscribed to unless you unsubscribe or terminate your account.
Privacy for children
You must be at least 16 years old to use our professional services. We do not knowingly solicit information from or market to children under the age of 16. If you become aware of any data we have collected from children under the age of 16, please contact us using the contact information provided below. We recommend that minors ask their parents’ permission before using our website or sending any information over the Internet.
Policies and shipping rates
Shipping address
Orders are sent to the shipping address entered on the order form. Make sure the address you enter is complete and accurate. The IKO is not responsible for packages that are non-delivered due to incorrect shipping addresses.
International buyers
All orders shipped to countries outside of the US may be subject to import taxes, customs duties and fees that must be paid by the buyer. The value of payment received cannot be altered to decrease international custom fees. Additional charges for customs clearance must be paid by the buyer at the time of pick up. We have no control over these charges. Customs policies vary widely from country to country, and you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our control and beyond the original delivery estimates.
Tracking
All orders shipped using Priority Mail or Express Shipping outside of the United States will have a tracking number. Refer to the UPS tracking platform - How do I track the delivery of my order?
Processing and delivery times
Orders are shipped when payment is received and approved by our Accounting Department. This process generally takes 2-4 business days.
Once the order has been shipped, the estimated delivery time depends on the shipping destination. You can check the map of shipping destinations here: https://www.printful.com/shipping
Delays can occur due to certain countries' customs regulations. If you do not receive your order after the maximum time specified, please email us. The IKO is not responsible for any delay in delivery once the order has left the IKO warehouse.
Damages, unclaimed and lost items
If your box is damaged on arrival, please open it in front of a postal or delivery representative to verify that all items are present according to the invoice attached. If something is missing or damaged, a declaration signed by both parties should be submitted to the IKO by email including a picture of the damaged product. We will then follow up on the claim with the postal or delivery company. If the declaration is not verified by both parties, the IKO will not follow-up on the claim.
The IKO is not responsible if the package was returned because the customer did not pick it up at the courier/Post Office. The IKO will resend the order provided the customer pays the additional shipping fee.
Under the Statute of Limitations, the time period within which you can complain about an order placed with the IKO is three months. After this period, complaints will not be handled by the IKO Head Office.
Returns and refund policy
The IKO will not provide a refund for any online service such as membership, eCourses or eBooks.
The IKO will allow returns for most items within 30 days of receipt of shipment.
To get a full refund:
- Items must be in new condition.
- Items must be returned with all original packaging and accessories.
- Clothing items must be unworn.
