In this agreement, "you" or "your" means any person or entity using the label (“Center” or “Center Manager”). Unless otherwise stated, "IKO," “us”, "we" or "our" will refer collectively to the IKO and its subsidiaries, affiliates, directors, officers, employees, agents and contractors.

This agreement is a contract between you and the IKO. This contract applies to your approval of the IKO Evolution Clinic Organizer Guide, label, any related products and services. This agreement affects your rights, and you should read it carefully.

Also, you confirm that all information given is accurate and that all documents submitted are legal and valid. Any change will be immediately forwarded to IKO office.

You have acquainted yourself with the standards including the chart of sanctions and will apply them.

As IKO Affiliated Center, you agree to the terms and conditions of this agreement, to the general terms and conditions of use, to the privacy policy, to the Kite Center agreement and any documents incorporated by reference. You further agree that this approval agreement forms a legally binding contract between you and the IKO under any applicable law or regulation. Any rights not expressly granted herein are reserved by the IKO. This agreement is subject to change by the IKO without prior notice.

Benefits:

This agreement gives you the right to organize and benefit of the Evolution Clinic concept, content use and IKO promotion as described in the KMC Organizer Guide.

Term and termination:

Once the KMC Organizer agreement is signed or accepted online, the IKO Affiliated Center can use the IKO Evolution Clinic name for the duration of its membership.

Faulting:

IKO will cancel the right to organize Evolution Clinics to any IKO Affiliated Center which would not respect the IKO standards

The use of Evolution Clinic name to advertise any other course will be sanctioned by cancellation of the IKO Affiliated Center recognition by IKO.

Any  Coach teachingEvolution Clinic outside of an IKO Affiliated Center or teaching an unregistered Evolution Clinic will lose his IKO recognition.

Unregistered Evolution Clinic will lead to the loss of IKO Affiliation for the Center and the Coach.

Unregistered Evolution Clinic participant by the end of the 1^st days of the Evolution Clinic will lead to loss of right to organize Evolution Clinic for the IKO Affiliated Center.

Faulting related to the no respect of any aspect of this agreement will lead to the loss of right to organize Evolution Clinics.

Evolution Clinic not directly managed and run by an IKO Coach will lead to the loss of Instructor and IKO Affiliated Center recognition.

Arbitration:

This agreement is governed by and interpreted under the laws of the Dominican Republic. Any controversy or claim arising out of or relating to this agreement or the provision of services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the Dominican Republic.

Through this agreement, you confirm that you have read and accepted the terms of the IKO Evolution Clinic Organizer agreement, and that the information that you have provided to the IKO is accurate.
